(1) CHECK-INS/CHECK-OUTS: Check-in time is 4pm EST and check-out time is 10am EST.
NO EARLY CHECK-INs. NO LATE CHECK-OUTs.
This agreement does not create a tenancy or residence. For ease of timely maintenance you must depart at the appropriate time.
Check-in and check-out requires you to phone or text us at 252.489-3879. No Late Check-outs! ****Any late check-outs shall have $50./per hour past 10am check out deducted from your deposit.
(2) FURNISHINGS: Nirvana is equipped and furnished to the owners needs. All furnishings must remain inside the cottage during your stay. Please don't rearrange the furniture.
(3) BEDDING/LINENS: Tenants must provide their own sheets, pillow cases, towels, beach towels and paper goods. You have the option to make arrangements with http://shoredetails.com (252-995-0055) for linen supplies. Nirvana sleeps only 5 (FIVE) persons. Pillows, blankets and mattress pads are provided.
(4) GRILLING: Grilling is permitted only on the grill provided. Please remember to clean it after each use.
(5) LOCKED AREAS: Any forced entry into owners storage areas is cause for immediate termination of lease and Tenant will be charged for damages and or missing items.
(6) MAXIMUM OCCUPANCY AND MISREPRESENTATION: Maximum LEGAL amount of house guests for this two bedroom cottage is five people. Unless other arrangements are specified and agreed to, in writing by the owner, Tenant shall agree NOT to exceed this maximum occupancy at any time during their stay. All occupants must be clearly stated on the beginning of this contract. Having additional people not listed on this contract is cause for immediate termination of the lease and owner assumes no liability for the non-mentioned guests. Absolutely NO REFUND will be given, no matter what.
(7) MINIMUM AGE: All rentals are to families, friends and responsible adults. Tenant signing this contract must be over the age of twenty-one. Tenant signing this contract must acknowledge that they will personally occupy the property for the entire lease period and will not sublet and portion the property. Occupancy restricted to the maximum occupancy as set forth in this lease. Violation of any of these terms shall give right to termination of lease without refund of rental funds and damage deposit. Tenant agrees that the property will not be used for any illegal or unlawful purpose. Occupancy and use of the premises in such a fashion that disturbs other nearby residents shall be deemed grounds for termination of lease and eviction from premises.
(8) FALSIFIED RESERVATIONS: Any reservation obtained under false pretense and or misrepresentation of guests will be subject to forfeiture of advance payment, deposit and or rental money and the party will not be permitted to check in nor will they be asked to be returning guests.
(9) CARE OF PROPERTY: Tenant is expected to care for the property as if it were their own. Tenants are notified that the North Carolina "Vacation Rental Act" provides certain obligations to the Tenant regarding care and use of the that unless property and the Tenant agrees to be bound and responsible for the provisions contained therein. In addition, Tenant acknowledges that unless the Owner is notified on the day of check in of any damage or cleaning concerns, then thereafter, all damages or concerns regarding the property during their occupancy will be the Tenants responsibility. Any damages or concerns must be reported to the Owner.
Anything other than the normal wear and tear will be deducted from the security deposit. Rearranging of the furniture is not permitted. Tenant must leave the property in a clean condition before checking out inclusive of the following:
(a) All trash must be removed & disposed of; (b)All dishes, pots, pans & utensils must be washed & put away; (c) The contents of the refrigerator, oven, cupboards & microwave must be emptied & wiped clean. (d) All floors & porches must be swept, vacuumed &/or mopped as needed; (e) Lock the front sliding door & return the key to the lock-box; (f) Please report any damage or breakage to the Owner; (g) Cottage must be left clean, the way you found it.
Failure to comply will give the Owner the right to deduct appropriate amount from the Tenants security/damage deposit.
(10) YOUR STUFF: We are not responsible for your lost, stolen, abandoned or forgotten items. Please be sure you have all the belongings you came with before you leave. If you are missing something, call and check to see if it has been found,. If an item has been located, we will ship it to you with a shipping and handling fee that's deducted from your deposit.
(11) DOG POLICY Only ONE DOG is allowed for an unrefundable fee of $100./stay provided that your dog has flea control and good house manners.
(12) DAMAGE/RESERVATION DEPOSIT: Your advance deposit of $150. is required. This payment is to be received within seven (7) days of the Tenants reservation, The deposit is not applied towards rent, however, it is usually fully refundable within about forty(40) days of your departure provided the following conditions are met: (a) All "Care of Property" rules previously stated are adhered to; (b) No damage is done to the cottage or its contents beyond normal wear and tear; (c) No charges are incurred due to contraband, pets or collection of rents and services rendered during stay; (d) All debris, rubbish and discards are placed in the trashcans outside; (e) Soiled dishes must be washed and put away;
(f) Refrigerator, oven, outside grill and microwave emptied and cleaned; (g) Tenants possessions from rooms, drawers, cabinets, closets and cupboards removed from premises; (h)The cottage door is secured by lock and the key returned to the key-safe; (i) No late check out; (j) The renter is not evicted by owner or representative of the owner, including but not limited to maintenance, housekeeping or law enforcement.
If these conditions are not met then applicable charges will be deducted from your deposit.
(13) PAYMENT: Advance payment in full is required thirty days before your arrival. The advance payment will be applied toward the rent. Please make payments in the form of personal check or cash. This payment is not a damage deposit.
(14) CANCELLATIONS & CHANGES: A sixty day written notice is required for cancellations. Cancellations that are made sixty days prior to arrival date will incur no penalty. Cancellations made after sixty days will not receive a refund unless cottage is re-rented and confirmed by the newer reservation for the cancelled period. Cancellations made the first day of rental will not be refunded. No credit will be given for shortened stays due to late arrival or early departure for any reason. There may be a $25. charge for processing. NO REFUNDS will be issued due to the lack of fish, lack of waves, too many insects or inclement weather. We suggest you to obtain LODGING INSURANCE elsewhere on your own at an additional cost to cover the possibility of your desire for reimbursement. (15) NO HOUSEKEEPING SERVICE: Daily housekeeping service is not available, nor provided nor included in the rental rate.
An additional fee of $100.plus applicable taxes, will be charged & deducted from damage deposit if tenant fails to leave this cottage reasonably clean.
(16) NO FIREWORKS: Fireworks or firecrackers are NOT ALLOWED to be discharged anywhere on Hatteras Island.
(17) RATE CHANGES: Rates are subject to change without notice. However, once you have signed your rental agreement contract, no rate changes will apply.
(18) WRITTEN EXCEPTIONS: Any exceptions to the above mentioned policies must be approved in writing in advance.
(19) HURRICANE POLICY: In the event of a hurricane, sustained damage from a hurricane or mandatory evacuations, the Tenant will not be entitled to a refund or rescheduling from the Owner for prorated rent for each night that you are unable to occupy the property because of the mandatory evacuation order. Pursuant to the North Carolina "Vacation Rental Act". you will be obligated to comply with and vacate the premises upon a mandatory evacuation order.
(20) WEATHER: Hatteras Island weather can be unpredictable. During the "hurricane season" you can experience delays in arrivals and evacuations if a storm threatens. The Owner does not refund rental monies or reschedule vacation stays for any weather related situation that may occur before or during your stay. It is the renters responsibility to obtain travel protection insurance. This is highly recommended.
(21) APPLIANCE MALFUNCTIONS: Any malfunctions will be addressed as quickly as possible provided that the Tenant notifies Owner of any major difficulties with the appliances during your stay. Every effort will be made to resolve the issues as soon as possible. There are no rebates or refunds issued to the Tenant for any reason as every good faith effort is made to insure that the property is maintained to the highest standards.
(22) INDEMNITY: The Tenant agrees to release and indemnify the Owner and her Agent from and against all liability should anyone be injured upon the premises during the term of the lease resulting from any cause whatsoever.
THIS IS A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA VACATION RENTAL ACT.
THE RIGHTS AND OBLIGATION OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR SIGNATURE ON THIS AGREEMENT OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY, AFTER RECEIPT OF THE AGREEMENT AND YOUR INTENT TO LEASE THIS PROPERTY FOR A VACATION RENTAL MAKES IT LEGALLY BINDING.

Reservations are preferred at least 50 days in advance but we do make some exceptions.
Send security deposit & signed contract first. First Payment of $150.00 is required in advance as a security/damage deposit (refundable)
Please send the $150.00 personal check (security deposit) payable to Nirvana-Hatteras with signed rental agreement. This deposit automatically converts to a security/damage deposit upon arrival. This deposit will be held, un-cashed, and is NOT applied towards rent, however it is fully refundable with in 60 days of your departure provided the conditions described in part six through part twelve of the above contract are met.
Full payment is due 30 days prior to your stay. When payment in full is received, you will be e-mailed check-in information about keys and such.
